ARTICLE 1 – PREAMBLE

1.1 Purpose

These General Conditions of Sale specify the rights and obligations of the customer with regard to the products sold in the electronic catalog of the website www.heleneprime.com within the framework of a distance selling system.

The contract, established in the event of an effective order, falls under the regulations of distance selling, as it results in particular from the Consumer Code, as well as from the specific provisions referred to below.

The order implies irrevocable adherence to the General Conditions of Sale. The customer declares to have the capacity to conclude this contract, that is to say to have the legal majority and not to be under guardianship or curatorship.

The unreserved acceptance of these General Conditions of Sale will consist in the fact, for the customer, of ticking the box “I accept the General Conditions of Sale”. Ticking this box will be deemed to have the same value as a handwritten signature from the customer.

ARTICLE 2 – CONTRACT

2.1 Order

After placing your order, we will send you an e-mail confirming it.

You can track the progress of your order by emailing HELENE PRIME PARIS customer service: contact@heleneprime.com. If the order has been sent, HELENE PRIME PARIS will provide a parcel tracking number to the customer, who can then track its delivery by visiting the websites made available by the Post Office: http://www.laposte.fr

2.2 Modification / cancellation of the order

In the event of an error concerning the elements of your order (address, size, etc.), you have the possibility of modifying or canceling it before it is processed and dispatched by us. For this, please contact us by email: contact@heleneprime.com.

2.3 Packaging

Each jewel purchased is carefully wrapped in a pouch and tissue paper. It is accompanied by a certificate of authenticity signed by the brand, as well as its purchase invoice.


ARTICLE 3 – AVAILABILITY, DELIVERY, PRICE

3.1 Availability and delivery

HÉLÈNE PRIME PARIS creations are produced in small series by skilled artisans in Paris. Any order for a product in stock is processed within 48 hours (excluding weekends and public holidays), following receipt of payment. If the item is not in stock, a special request is sent to the workshop to make it as soon as possible, and it is shipped within 1 to 3 weeks, depending on the availability of parts.

If, despite our efforts, a product cannot be delivered, we will notify you by e-mail and/or telephone as soon as possible and your order will be cancelled, without this giving rise to any compensation other than refund of the order.

In the event of non-delivery due to an incorrect address provided by the customer, or any other cause of his own (absence of name on the mailbox, lack of information, etc.), the return of the package will be reorganized, at the expense of the customer.

3.2 Special orders

So-called “special” orders refer to the tailor-made creation of a piece of jewellery. Any buyer wishing to make a special order is invited to contact our customer service in order to know the feasibility of his request, to receive a quote and to be informed of the shipping times.

3.3 Price

The prices of the products are those indicated on the site regardless of the place of delivery and include all French taxes (TTC), excluding delivery costs, which are the responsibility of the customer.

Additional taxes (sales tax on imports, customs duty or handling fees) may be applied by the customs office of the country concerned and remain your responsibility. The recipient of the parcel will then be invoiced by the carrier. By placing an order on our site, you accept the rules for importing goods; please note that import rules vary by country. These taxes cannot be refunded in case of return or exchange.

We reserve the right to change our prices without notice and at any time. Products already ordered will be invoiced according to the prices at the time of registration of your order.

3.4 Delivery time and costs

The site delivers worldwide. The ordered product is delivered to the address appearing on the customer's order form, with the exception of the choice of the "Collection in showroom" option. The delivery address may differ from the billing address.

The delivery time depends on the delivery address as well as the means of delivery selected by the customer. Any possible delay related to the customs clearance of the exported goods does not engage the responsibility of the company.

The delivery times specified below only run from the dispatch of the order.

Delivery in France is made, at the initiative of the customer, by one of the following transport options:

La Poste (Colissimo with delivery against signature): Delivery within 1 to 3 working days after dispatch

UPS: Delivery within 1 to 3 working days after shipment

Withdrawal from the showroom: Delivery to the showroom within 48 hours at the latest for any order placed before 3 p.m. (French time), working day.

International delivery (excluding mainland France, Monaco and Andorra) must be made by the carrier UPS.

Delivery costs are free from an amount equal to or greater than €200 for France (standard delivery), and €500 outside France.

In the event of damage, the customer formulates his reservations with precision and clarity on the delivery note, a copy of which is sent by La Poste or by the carrier to the company. In this regard, it is the customer's responsibility to check the content, conformity and condition of the product upon delivery. This verification is deemed to have been carried out when the customer, or a person duly authorized by him, has signed the delivery note presented by the receiver of La Poste or by the carrier.

 

ARTICLE 4 – PAYMENT

4.1 Terms of payment

You can pay by the following bank cards: CB, Visa, Mastercard, American Express, Apple Pay.

Payments by check or money order are not accepted.

4.2 Payment Information

In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By communicating his bank card number and the aforementioned information, the customer authorizes the company to debit his credit card for the total amount including VAT of his order (delivery costs included).

To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on this bank card to be debited is his own, then communicates in a secure environment on the site of our payment partner, the number to sixteen digits and the expiry date, appearing on the front of his bank card, as well as, where applicable, the numbers of the visual cryptogram appearing on the back of his bank card.

In order to provide additional security to online payment by credit card, this payment will benefit from the 3D secure program. This program aims to fight against fraud by asking the Internet user who wishes to make a payment on the Internet, to identify himself at the time of payment by credit card on the e-tailer's site. During the transaction, the bank card holder is directed to a page of his bank and enters data that the latter can verify. This security is materialized by the presence of the “Verified by VISA” or “MasterCard SecureCode” logos.

4.3 Refusal of payment and cancellation of order

For security reasons, we reserve the right to refuse payments and thus cancel orders:

for an unreferenced delivery address

if we are unable to reach the person who placed the order

for any doubt on the validity of the order

ARTICLE 5 – RETENTION OF OWNERSHIP

The delivered goods will remain our property until you take physical possession of the delivered product once you have paid the price.


ARTICLE 6 – RETURN POLICY

6.1 Deadline and return address

In accordance with articles L 121-20 and following of the Consumer Code, the customer has a cooling-off period of fourteen (14) clear days from delivery to reconsider his decision and return the item ordered without having to give reasons or pay penalties.

The customer must notify his decision to withdraw within 14 days after receipt of your invoice, by contacting us by email at contact@heleneprime.com.

Returns must be made to the following address: HELENE PRIME PARIS, 5 rue de Villersexel, 75007 Paris. Please note, from this day on, you have one week to return your parts. After this time, your return package can unfortunately no longer be taken into account and will be forwarded to you.

You also have the option of returning your items directly to the HELENE PRIME PARIS showroom, within the time allowed.

6.2 Applicable fees

If you wish to return an item, HELENE PRIME PARIS will reimburse you for the reimbursement of the payments received and, in the event of the return of a global order only (all the products ordered in a single order), the delivery costs. In case of partial return, delivery costs will not be refunded. The delivery costs reimbursed will be on the basis of the standard delivery method (the most economical). If the customer has chosen a delivery method other than the standard delivery method, the additional costs charged will not be refunded.

Return costs are free for France only.

Customs charges may be applied and are the responsibility of the customer for reception in countries outside the EU and in the DOM-TOMs.

If the return is due to an error on our part, the return costs that have been paid by the customer will be refunded to him.

6.3 Product conformity

The product must be in perfect condition, provided with its original packaging and its purchase invoice. Items returned that are non-compliant or unsuitable for resale, i.e. subject to modification, misuse (shock for example), neglect of maintenance (see our maintenance advice ), or normal wear and tear of the item by the customer will not be refunded, and the part will be sent back to you.

In accordance with the provisions of article L121-21-8 of the Consumer Code, products corresponding to special orders (made to measure) cannot be exchanged or refunded.

The risks of return are always the responsibility of the customer. The customer is therefore strongly encouraged to return the package by any means that provides proof of its dispatch and giving it a certain date (registered with acknowledgment of receipt, colissimo followed, etc.). Otherwise, HELENE PRIME PARIS will not be able to process your return.

6.4 Reimbursement period

Upon receipt of the package, we will check the integrity of the items before accepting your return and requesting a refund. The refund will be made within fourteen (14) days, directly to the card used for the original purchase, in the same currency. We will send you a confirmation email as soon as we have made the refund request.

For any exchange (product in another size or other stone(s)), we advise you to reorder, and send an email to contact@heleneprime.com to have the shipping costs of the second refunded. ordered.

For any other information, complaint or question relating to the conditions of sale by correspondence put in place by the company, customers must send an e-mail to the following address: contact@heleneprime.com, mentioning in both cases the reference and the date of the order.


ARTICLE 7 – WARRANTY

All products benefit from the legal regime of the guarantee of conformity provided for in articles L217-4 and following of the Consumer Code.

Under this warranty, when the legal conditions are met, the customer has a period of two (2) years from receipt of the product to request the repair of it or its replacement subject to the conditions of cost. provided for by article L217-9 of the Consumer Code. The customer is exempted from providing proof of the existence of the lack of conformity during the six (6) months following the delivery of the goods.

The products also benefit from the legal regime of the guarantee against hidden defects within the meaning of article 1641 and following of the Civil Code.

Under this guarantee, the customer can choose between the resolution of the sale or a reduction in the price of the product.

The following are thus excluded from the warranty: items subject to modification, misuse (shock for example), negligent maintenance (see our maintenance advice ), or normal wear and tear of the item by the customer.


ARTICLE 8 – DATA CONFIDENTIALITY


The company HELENE PRIME PARIS manages an electronic file which lists certain personal data relating to its customers. When an order is placed on the www.heleneprime.com site by any new customer, this database is enriched by means of information concerning him, which will subsequently make it possible to better meet his expectations and facilitate assistance services provided by the HELENE PRIME PARIS Customer Service.

In the event that the customer consents to communicate individual personal data, he would then have the individual right of access, withdrawal and rectification provided for by law and may in this respect have the information concerning him deleted which is not more relevant, by making the request in writing to the company HELENE PRIME PARIS, send an email to the following address: contact@heleneprime.com.

 

ARTICLE 9 – INTELLECTUAL PROPERTY RIGHTS

The “HELENE PRIME PARIS” brand, the photos, logos and slogans, the designs and models appearing on the site are and will remain the exclusive property of the company. Any total or partial reproduction, without the express and prior consent of the company, is strictly prohibited pursuant to articles L 335-2 and L 335-3 of the intellectual property code and constitutes an infringement and an offence.

 

ARTICLE 10 – APPLICABLE LAW

These General Conditions of Sale and the commercial relationship between the company and the customer are governed by French law. Any dispute relating to the commercial relationship between the company and the customer will be subject to the jurisdiction of the French courts.
